Case: Transfer case concerning Eduarda Idalina Amorim (Brazilian citizen)

Eduarda Idalina AmorimVienna, 16.11.2007 – Following a legal dispute concerning the player Eduarda Idalina Amorim of Brazil, the European Handball Federation herewith makes the following official statement, which therefore brings this case to a close.

The player in question has a valid contract with Kometal Djorce Petrov Skopje (MKD). The dispute involves the club, Kometal Djorce Petrov Skopje (MKD) and the club, Hypo Niederösterreich (AUT) concerning the player in question. The player filed a petition for a temporary injunction for a player eligibility to be issued for Hypo Niederösterrich.

The case went through the EHF legal mechanisms, where both EHF Instances declared the contract with Kometal Djorce Petrov Skopje (MKD) to be valid and therefore binding. The player then put the case to an industrial court in Wr. Neustadt (AUT) and following this to a court of law in Vienna (EHF Headquarters). The case was dismissed by the court and the contract with Kometal Djorce Petrov Skopje (MKD) declared as valid. Therefore the player is not eligible to play for Hypo Niederösterreich (AUT).

The decision of the Austrian Court of Law underlines the legal framework and decision-making process in the sport, which represents the core principle of justice.
